Terms of Service

These terms are an agreement between you and Old Blue Chair LLC, the company that owns and operates FoilFox. They govern your use of the FoilFox website, application, APIs, scanner, catalog, marketplace, and collection-management features. By using an account-backed feature, you agree to these terms.

The preview

FoilFox is an early-stage service. Features, supported cards, providers, availability, and limits may change as the product is tested. We may modify or discontinue preview functionality, but we will not intentionally prevent you from requesting an export of supported account data solely to force a subscription.

Your account

FoilFox uses Google for marketplace authentication and offers Google or Apple authentication in supported collection-app experiences. You are responsible for access to your sign-in provider account, devices, and active FoilFox sessions. Provide accurate information and notify us at support@foilfox.cards if you suspect unauthorized access.

Eligibility and supervised use

FoilFox is a general-audience service and is not directed to children under 13. FoilFox does not offer accounts to children under 13, who may use only public browsing. The person who owns a FoilFox account must be able to form a binding agreement where they live. Other people who cannot legally accept these terms may use FoilFox only through an account owned and managed by a parent or guardian who accepts these terms and supervises use.

Buying, selling, reservations, payment setup, payouts, and seller operations require an adult account holder or an authorized adult business representative. Payment processors may require separate identity, tax, banking, and risk verification. A payment method is a transaction control, not a promise by FoilFox that every holder is an adult.

FoilFox does not routinely request a birth date or age range. If FoilFox learns that an account is held by a child under 13 without legally sufficient parental consent, FoilFox may immediately restrict the account and delete associated personal information. If FoilFox learns that a marketplace participant lacks legal capacity, marketplace activity may be blocked or cancelled. Report a concern to support@foilfox.cards.

Your cards, images, and records

You retain your rights in collection records and images you submit. You grant FoilFox and its service providers a limited license to host, transmit, process, reproduce, and format that material only as needed to provide, secure, support, and improve the features you choose to use.

You must have the right to submit an image or record. Do not upload sensitive personal information, illegal material, unrelated content, or images that violate another person's rights.

Acceptable use

Do not misuse FoilFox. This includes attempting to bypass security or usage limits, disrupt the service, probe other users' data, automate abusive requests, introduce malicious code, scrape restricted sources through FoilFox, impersonate another person, or use the service for unlawful activity. We may limit or suspend access reasonably necessary to protect FoilFox, its users, and its providers.

Scanner, catalog, pricing, and condition

Recognition output is a proposed match, not catalog truth. You are responsible for reviewing the card, printing, language, variant, and quantity before saving or relying on a result. Catalog records can contain omissions or errors.

Any future price, condition, or grading information is informational only. FoilFox does not guarantee a market price, sale outcome, card condition, authenticity, professional grade, or appraisal. Verify important details independently before buying, selling, trading, grading, insuring, or reporting taxes.

Seller and shop tools

Inventory connectors, seller APIs, marketplace synchronization, and related shop tools described on the website are planned capabilities unless expressly marked available. Marketing descriptions are not a promise that a future feature will ship on a particular date or support a particular marketplace.

FoilFox and third-party intellectual property

FoilFox's original software, brand, logo, and design are protected by applicable intellectual-property laws. These terms do not transfer FoilFox ownership to you.

FoilFox is an independent collection-management tool. It is not affiliated with, endorsed by, or sponsored by Nintendo, Creatures Inc., GAME FREAK inc., or The Pokémon Company. Pokémon and all related names and marks are trademarks of their respective owners. References to cards, games, marketplaces, grading companies, or other third parties are used for identification and interoperability and do not imply endorsement.

Third-party services

FoilFox relies on third-party services including Google, Cloudflare, and OpenAI. Your use of those services may also be governed by their terms and policies. FoilFox is not responsible for third-party services outside its control.

Termination and deletion

You may stop using FoilFox at any time and may request account-data deletion by emailing support@foilfox.cards. We may suspend or terminate access for material violations of these terms, security threats, legal requirements, or service discontinuation.

Disclaimers and liability

To the extent permitted by law, the preview is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, or non-infringement. FoilFox is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost opportunities, or losses caused by relying on a scan, catalog, price, condition, or inventory result. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.

Governing law and venue

These terms and any dispute arising out of or relating to FoilFox are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You and FoilFox agree that any such dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Dallas County, Texas, and both parties consent to the personal jurisdiction of those courts. Before filing, please contact us at the address below — most issues can be resolved directly. Nothing in this section limits rights that your local law grants you and does not allow to be limited by agreement.

Changes

We may update these terms as the service changes. The effective date above will change when updated terms are published. Continued use after an update means you accept the revised terms to the extent permitted by law.
